Acceptance of Terms

By accessing or using the services provided by gardenmkpg B.V. ("gardenmkpg," "we," "our," or "us"), including visiting our facility, using our website, or participating in our weight loss and body transformation programmes, you ("you," "your," or "client") agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use our services or visit our facility. These Terms constitute a legally binding agreement between you and gardenmkpg.

Services Description

gardenmkpg provides weight loss and body transformation services including but not limited to:

• Personal training sessions
• Nutrition coaching and meal planning
• Group fitness classes
• Body composition analysis
• Lifestyle and wellness coaching
• Progress tracking and monitoring

All services are provided by qualified professionals and are designed to support your health and fitness goals. Services may be modified or discontinued at gardenmkpg's discretion with reasonable notice.

Client Obligations and Responsibilities

As a client of gardenmkpg, you agree to:

• Provide accurate and complete health information and medical history
• Follow safety guidelines and instructions provided by our staff
• Arrive on time for scheduled appointments and notify us of cancellations at least 24 hours in advance
• Treat all staff and other clients with respect and courtesy
• Pay all fees and charges in accordance with agreed payment terms
• Inform us immediately of any injuries, health changes, or medical conditions
• Use equipment properly and report any damage or safety concerns
• Comply with facility rules and regulations

Health and Safety

Your health and safety are our primary concerns. You acknowledge and agree that:

• You are physically capable of participating in the selected programmes
• You will consult with your physician before beginning any new exercise or nutrition programme
• You will immediately inform us of any health conditions, injuries, or medications that may affect your ability to exercise safely
• You understand that physical exercise involves inherent risks
• You will follow all safety instructions and use equipment properly

Payment Terms and Cancellation Policy

Payment for services is due according to the agreed schedule. Late payments may result in suspension of services. Cancellation policies vary by service type:

• Individual sessions: 24-hour cancellation notice required
• Monthly programmes: 30-day written notice required
• Annual programmes: Subject to specific contract terms

Refunds are provided in accordance with our cancellation policy and applicable consumer protection laws. No refunds are provided for services already rendered.

Intellectual Property

All content, materials, programmes, and methodologies provided by gardenmkpg, including but not limited to workout plans, nutrition guides, educational materials, and proprietary training methods, are the intellectual property of gardenmkpg and are protected by copyright and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any gardenmkpg materials without express written permission. The gardenmkpg name, logo, and branding are trademarks of gardenmkpg B.V.

Privacy and Confidentiality

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We maintain strict confidentiality regarding your health information and personal data.

You consent to the collection and use of your information as described in our Privacy Policy, including health and fitness data necessary to provide our services effectively.

Our services are provided "as is" and "as available." We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify and hold harmless gardenmkpg, its employees, contractors, and affiliates from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or violation of any rights of another party.

Termination

Either party may terminate the service relationship at any time with appropriate notice as specified in the service agreement. gardenmkpg reserves the right to immediately terminate services for:

• Violation of these Terms
• Non-payment of fees
• Inappropriate behaviour toward staff or other clients
• Safety violations
• Providing false health information

Upon termination, all rights and obligations cease except those that by their nature should survive termination.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Changes to Terms
